FLEX TRADE PROMOTION
TERMS AND CONDITIONS

1. Promoter

The Promoter of this Promotion is Chervon Australia Pty Ltd (ABN 36 165 077 501) of Unit 14, 5 Kelletts Rd, Rowville, VIC 3178 ("Promoter", "we", "us", "our"), trading as FLEX.

2. Entry Period

Promotion opens: 9:00am AEST/AEDT on 10th August 2026
Promotion closes: 11:59pm AEST/AEDT on 20th September 2026

Entries received outside the Entry Period will not be accepted.

3. Eligibility

• Entry is open to residents of Australia aged 18 years or over.
• This Promotion is only open to residents of Victoria, New South Wales, Queensland, South Australia, and Western Australia.
• Employees (and their immediate families) of the Promoter, its associated agencies and any content creators or influencers engaged in connection with this Promotion are ineligible to enter.

By entering, entrants warrant they meet all eligibility requirements above. The Promoter reserves the right to verify eligibility and disqualify any entrant who does not comply with these Terms and Conditions.

4. How to Enter

Entrants may enter this Promotion during the Entry Period via Meta platforms (Facebook and Instagram), by completing the native lead generation form contained within the Promotion's advertisement on Facebook or Instagram.

To constitute a valid entry, an entrant must:

1. provide their full name, email address, telephone number; and
2. answer the entry question, "What trade are you in?" (for example: carpenter, electrician, plumber); and
3. submit the completed form.

Each valid entry will be included in the random prize draw.

It is not a condition of entry that an entrant agree to receive marketing communications from the Promoter. Entrants may choose to opt in to receive such communications separately, and doing so has no bearing on entry validity or an entrant's chances of winning.

Limit of one (1) entry per person for the duration of the Entry Period. Multiple entries from the same person will be disqualified, and only the first valid entry received will be counted.

No purchase is necessary to enter. Entry is free.

The Promoter accepts no responsibility for entries that are late, lost, misdirected, incomplete, or not received for any reason, including due to technical disruptions, network congestion, or error.

5. Prizes

There are two (2) prizes available to be won, each consisting of:

• One (1) FLEX 24V 8-Piece Combo Kit (Hammer Drill, Impact Driver, Grinder, Circular Saw, Rotary Hammer, Reciprocating Saw, Multi-Tool, Sander, Charger and 3 x 5.0Ah Batteries) — RRP $2,199 (inc. GST)
• One (1) FLEX Stack Pack Medium Tool Box — RRP $209 (inc. GST)

Total prize value per winner: $2,408 (inc. GST). Total prize pool for this Promotion: $4,816 (inc. GST).

Prizes are not transferable or exchangeable and cannot be redeemed for cash, in whole or in part. If a prize (or any component of it) is unavailable, the Promoter reserves the right to substitute it with a prize of equal or greater value, subject to any applicable state legislation.

6. Winner Selection

Winners will be determined by a random draw of all valid entries received during the Entry Period.

Draw date and location: 21st September 2026 at the Chervon Australia office, Unit 14, 5 Kelletts Rd, Rowville, VIC 3178

The draw will be conducted in a manner that gives all eligible entrants an equal chance of winning.

7. Winner Notification

• Winners will be notified using the contact details provided at entry. The Promoter will make at least three (3) attempts to contact each winner, via both email and phone.
• If, following these attempts, a winner cannot be contacted, or does not respond and claim their prize within one (1) week of the first contact attempt, the winner will forfeit their prize.

Where a winner forfeits their prize, the following redraw process will apply:

• The Promoter will conduct a further random draw from the remaining eligible entries, using the same method as the original draw, to select a replacement winner.
• The replacement winner will then be notified and subject to the same contact, response timeframe, and forfeiture conditions set out above.
• This process will be repeated, as needed, until a prize is validly claimed or the Promoter reasonably exhausts the pool of eligible entries.
• Any redraw will take place at the Promoter's office (or such other location as the Promoter determines) and will be recorded by the Promoter.

Winners will also be announced publicly via FLEX's official social media channels.

8. Publicity and Consent

By entering this Promotion, winners consent to the Promoter publishing their name in connection with the Promotion (including on FLEX social media channels) and to being featured in Promotion-related video content, without further compensation, in perpetuity, unless prohibited by law.

9. Privacy

The Promoter collects personal information from entrants to conduct this Promotion, including to contact winners and fulfil prizes. Personal information is collected, used, stored, and disclosed in accordance with the FLEX Privacy Policy, available at: https://flex-tools.com.au/privacy-policy

Entrants may request access to, or correction of, their personal information by contacting the Promoter's Privacy Compliance Officer at support@flex-tools.com.au or 1300 000 346.

10. General Conditions

• The Promoter's decision in connection with this Promotion is final, and no correspondence will be entered into.
• The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
• The Promoter reserves the right to amend, suspend, or cancel the Promotion, or any part of it, if it becomes necessary to do so for reasons outside its reasonable control, subject to any written directions of a relevant state or territory regulator.
• To the extent permitted by law, the Promoter (including its officers, employees, and agents) excludes all liability for any loss (including but not limited to indirect or consequential loss), damage, personal injury, or death that may occur in connection with this Promotion or as a result of accepting a prize, except for any liability that cannot be excluded by law.
• Nothing in these Terms and Conditions limits, excludes, or modifies any guarantees under the Australian Consumer Law.

11. No Permit

This Promotion has a total prize pool below the permit thresholds applicable in the states in which it is conducted, and accordingly no trade promotion permit is required.
